GOVERNMENT NOT INTERESTED TO REMOVE CAPITATION FEE DISEASE FROM ITS ROOTS


                        
                   
                By increasing penalty for demanding capitation fees by Universities and Technical Educational Institutions- can actually and virtually eliminate the habits of management to take capitation fee-it is doubtful because the government intention is never to eliminate the corruption  from its roots rather it tried to cut shed stems & leaves.

Yesterday, in an effort to curb unfair practices in the higher education segment, the government in his cabinet meeting has doubled the penalty of Rs.1.00 crore that institutions will have to pay for demanding a capitation fee. The Cabinet approved a amendment for prohibition of Unfair Practices in Technical Educational Institutions, Medical Educational Institutions and Universities Bill, 2010, which is  renamed as Higher Educational Institutions Act, 2011.

The very purpose of the amendments aim to provide an institutional mechanism for preventing, prohibiting and punishing unfair practices in technical,
universities and medical educational institutions  will be defeated so long so there remain management quota with the private institutions because  who will keep eagle eyes on their conducts unless some aggrieved student approach the appropriate authority. The fees could have been collected by third party or at home of director or any trustee’s employee in India.


              
                        It is world known and has been proved in sting operation also carried out on various universities by AAJTAK TV channel- the marketing for unfair means are being carried out by trusted employee who are trolling students for distributing PhDs degrees with 1.25 lacs rupees without doing any research.

It will be impossible to prove that management is demanding capitation fees without any sting operation. Secondly,  for medical institutions who charge Rs.25.00lacs to 1 crore from different faculty from students-their parents who are doctors in profession are eager to give for their wards-1 crore penalty is just like cumin seeds in the mouth of camel.

 The new amendment to the previous bill may bring all higher educational institutions except agriculture education and research-which is a state subject, under its purview and ambit-to safe guard the interest of the student from paying capitation fee. The bill will not serve any purpose and become mockery in the hands of delinquent management whose merely aims are to mint money not to deliver standard qualification even.

Bill was also amended for failure to meet any promise made in the prospectus, would also be an offence which includes increasing the penal provisions for charging
capitation fee from Rs 50 lakhs to Rs.1 crore, it is laudable step.

The Bill will have provisions for a grievance redressal mechanism. What so ever the mechanism is formed to deal with unfair means will not bring any fruits unless management quota is totally removed, unfair practices are beyond the scope of any such regulation or any regulatory body.
